Washington, Dee. 5—Judge Humphreys this morning delivered his opinion in the matter of John J. Patterson, relator, on ha-beas corpus, to be released from warrant of arrest on requisition [of the Governor of South Carolina. There were present, among others, Senator Patterson and two of hie counsel, Cook and Shelbarger, and Mr. Lowden, attorney of South Carolina. The Judges opinion was elaborate. He de-nied the power of the State of South Caro-lina to vacate Senator Patterson’s com-mission, which [must [continue until con-stitutionally revoked, In pursuance of or-ganic authority. It would not be said that Patterson was a fugitive from jus-tice, as he was here in the discharge of his official duties, like [all other members of Congress. And besides he had acted In the capacity of a Senator years before the present Indictment was, brought against him In the South Carolina courts. The writ was granted, and defendant dis charged. In the elections committee of the House three reports were read, one by Cox, one by Ilicock, (rep,) to seat Belfotd, snd one oy Sprlagber, (dem ) to seat Patterson (from Colorado). The committee will report to-morrow. A majarlty and minority of the privileges and elections committee are preparing elaborate reports on the Eustis ease, which will be printed to-morrow m elaboration of the report.. The [resolution Is six to three that Eustis Is entitled to the seat. The President Is again quoted by persons who visited him yesterday, that he would re-new all no mlnutions upon which adverse reports have been made by committees 1 a executive session. If this determination holds, all will be renominated except the New York Custom House officers and San-lord as minister to Belgium. * Gen. Ord was before toe military commit-tee to-day. His evidence accords with that of other officers to the effect that two regl-ments, one of cavalry and one of Infantry, are needed for proper protection of the border. The Democratic caucus of the House this evening voted to endorse and support the caucus of the Republican Senators, so as to arrange.The committee agreed to allow the Democrats Increased representation on all important committees except those on Railroads and Privileges and Elections. Caucus placed Keljogg on the committee of Pensions, Transportation, R ices to Sea Board and Levees. Senators Wendom and Matthews w ere placed on committee on Railroads. Vice President and Secretary Sherman visited the White House to-day. The Commissioner of General Land .Of-fice Is preparing a bill for sale or disposal of timber and let timber, lands In accordance of recommendation of the Secretary of In-terlor and himself in thetr reports, which will provide for the withdrawal of all land chiefly valuable for timber and not suitable for agricultural purposes from operation of the homestead preemption law and from liability to be taken by any of the various kinds of land scrip heretofore provided for by law.
