Senate Bill No. 110.J, P, j AN ACT ,To establish ft Ciiminal Court In and for the Cities of Wac9 ami Marlin and deliKlng the power* thereof. Section 1. Be it enacted by the Legislature of the State of Texas, That there is hereby, created aDd es-tablished at the city of Waco, in the county ot McLennan, and at the city oi Marlin, in the county of Falls, each a court of original and exclusive ju-risdiction (except as hereinafter pro-vided,) in all cases of felony, and con-current jurisdiction in all cases of misdemeanor, co-exlensive with the limits of the comities wherein said cities are situated; and tbe Judge thereof shall, by virtue of his office, have all the powers, and perform all the duties appertaining to Judges of the Distriot Courts within this State in all criminal matters,and to grant all such writs and process as a District Judge can or may do in the execu-tion of the criminal laws of this State, and said courts shall have and exercise appellate jurisdiction and the same general control over inferior tribunals in said connlies in criminal cases, as is now exercised by District Courts, and all appeals from the judg-ments oi said courts herein established shall be to the Supreme Court, in the same manner, and under the same regulations as are now, or may herealter be provided by law for appeals in criminal cases from district courts? Sec. 2. Said courts and the judge thereof shall have power to issue the writ ol habeas corpus and such other writs as may be necessary to enforce their own pi oper j unsdietieu. Sec. 3. The said courts, in each city, shall have a seal similar to those of the Distriot Court, with the words “Criminal Court ol---------engraved thereoo, j,the bl&uk to bo filled with the name oi the proper city, an ins# pression of which acal shall be at-tached to all writs and other process, exeept subpoenas, issueing from said court, and shall be used in,the authen-licatiwa of all official acts of said court, or the clerk thereof,^and certi-fied copies of all orders, proceedings, iudgcacuts and othtii acts of said court, under the hand of the clerk thereof, attested with the seal of the court, taken from the minutes and re-cords thereof, shall he admissible in. evidence in ail courts of this State in like manner as similar certified copies from the District Courts are now or may hereafter be admissible. Sec. 4. There shall be appointed by the Governor, by and with the ad-vice and consent of the Senate, a jadge oi said courts, who shall hold his office for the term of six years, and shall be removable in the same manner as Judges ol the Distriot Couils. Should a va# cauey occur in said office during a recess of the Senate, tbe Governor shall fill the same by appointment, which shall be sent to the Senate within ten days alter that body shall assemble, and if not confirmed thu office shall immediately become* va* cant. Sec. 5. The terms of said conns shall be held as follows, to wit: at Marlin, in the county oi Fails, on the first Mondaysjn January, May and September in each year, and msy con-linueiu session three weeks; at Waco oft the fourth , Mondays in January, May and September, in each r year, and may continue in session foui weeks. Sec. t>- The trials amt proceed-in03 iu uftid courts shall be conducted according to the laws in force gov» eming the rules of pleading, practice and evidence in tht District Courts, and the regulationso! the Renal Code, Code of Criminal Procedure, aud all other laws with reference u> criminal practice and proceduie, to the finvs aud forfeitures, and to grand and petit jurors shall be applicable to saitjl courts. U Sec. judge of said courts to eichange, or alternate, with any district judge as provided by law in .criminal matters; but said judge shall not praetice in any Court of the State during the time he holds said office. Sec. 10. The'judge of the CrimB nal Courts, herein established, shall receive an annual salary of twenty-five hundred dollars, to be paid by the counties incladed in this order iu the proportion following, that is to say : the county of McLennan shall pay fifteen hundred dollars of said annual salary, and the county of Falls shall pay one thousand dollars of said annual salary. Said salary shall be paid quarterly, and shall constitute a preferred claim against said counties; aud the County Court of each of said counties shall make provision ler the prompt payment of their respective portions of said salary, at the end of each and ever^ quarier, m mosey. While her husband may be guilty of the crimes charged against him, his wife was innoceut, and the manner in which she rescued him, her culture, elegance, and good standing, have enlisted iu her befialf the sympathy of ail l who kueW her; and her sudden death trom vhe causes which led to it render this* sympathy still greater and indicate clearly that while she was a true wife, ready to succor her n us baud uuderjany circumstances,she was also a vruj, honorable woman, who could not “suffer the stings and arrows of outrageous fortune,” nor bear the disgrace attached to a blasted name. The London Telegraph correspond-ent, writing of the arrival of the Afri-cau explorer’s body at Southampton, supplies the following sketch of the faithful attendant of tbe deceased: “The uiaiu interest neutered iu a short, stout negro lad of five feet one or two inches, with au intelligent countenance of a rather superior ndrican type, though its symmetry was fomewhat spoiled by being swollen about the mouth from the ac- Bidental blowing of a fly-rope during the gale.
